But how?"},"content":{"rendered":"<p>\n<\/p>\n<div data-element=\"story-body\" data-subscriber-content=\"\">\n<p>Driverless cars haven&#8217;t always followed the rules of the road, but unlike vehicles with humans behind the wheel, they&#8217;ve gotten away with it. <\/p>\n<p>That&#8217;s about to change.<\/p>\n<p>A series based on statewide autonomous vehicle regulations <a rel=\"nofollow noopener\" target=\"_blank\" class=\"link\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240AB1777\">Assembly Bill 1777<\/a> Will take effect July 1 \u2013 including a process to issue a \u201cNotice of AV Non-Compliance\u201d to law enforcement. <a rel=\"nofollow noopener\" target=\"_blank\" class=\"link\" href=\"https:\/\/www.dmv.ca.gov\/portal\/news-and-media\/new-autonomous-vehicle-regulations-strengthen-oversight-and-enforcement-authorize-trucks-and-transit\/\">California Department of Motor Vehicles announced<\/a> Tuesday<\/p>\n<p>Here&#8217;s how this new law will work, and what other regulations self-driving vehicle manufacturers will soon have to follow: <\/p>\n<h2 id=\"where-the-rubber-and-robots-meet-the-road\" class=\"subhead\">Where rubber and robot meet the road<\/h2>\n<p>The new regulation was developed &#8220;to address the gap in how moving violations are handled for autonomous vehicles,&#8221; said DMV spokesman Jonathan Groveman. <\/p>\n<p>Although California is home to several autonomous vehicle operators, the most widespread at this point is Waymo \u2014 which has driverless robotaxis piloting passengers in the San Francisco Bay Area and dozens of cities. <a rel=\"nofollow noopener\" target=\"_blank\" class=\"link\" href=\"https:\/\/www.dmv.ca.gov\/portal\/vehicle-industry-services\/autonomous-vehicles\/autonomous-vehicle-testing-permit-holders\/waymo-approved-areas-of-operation-for-driverless-testing-and-deployment\/\">Los Angeles County<\/a>.<\/p>\n<p>Seven months ago, a self-driving Waymo made an illegal U-turn at a traffic light right in front of police officers in San Bruno. <\/p>\n<p> <a rel=\"nofollow noopener\" target=\"_blank\" class=\"link\" href=\"https:\/\/www.facebook.com\/sanbrunopolice\/posts\/pfbid0YB5TDDbdZJydeQZrUCQdQr5daot5GwYtoPpoaDrwTEDxJB7Ljr9nVXu3cZe89yX5l\">Image of an officer peeping<\/a> Sitting in the empty driver&#8217;s seat of a criminal vehicle may be good for a laugh, but other incidents have been no laughing matter. Situations like Waymo not stopping for a school bus in Atlanta or hitting a child in Santa Monica highlight how law enforcement officers can&#8217;t perform traditional traffic enforcement with driverless cars. <\/p>\n<p>Under previous state law, traffic violations were issued to a human driver &#8220;to address driving behavior&#8221; and were &#8220;applied to that person&#8217;s driver&#8217;s license,&#8221; Groveman said in an email. <\/p>\n<p>\u201cBecause autonomous vehicles do not have a human driver \u2014 and existing citations must be issued to a licensed person \u2014 the law establishes a new mechanism that allows an autonomous vehicle manufacturer to issue moving violations,\u201d he said.<\/p>\n<p>According to Groveman, manufacturers must submit a &#8220;First Responder Interaction Plan&#8221; to the DMV and post it online. Those plans outline how law enforcement can interact with the vehicle and where officers can find important information like registration and insurance documents.<\/p>\n<p>&#8220;Driverless vehicles are expected to recognize law enforcement lights and sirens and proceed when appropriate,&#8221; Groveman said. <\/p>\n<p>For example, if there is a scenario of a traffic violation involving a driverless car that results in a collision, an officer can send the violation case to the manufacturer&#8217;s designated person, who will arrive at the scene. <a rel=\"nofollow noopener\" target=\"_blank\" class=\"link\" href=\"https:\/\/www.dmv.ca.gov\/portal\/file\/adopted-regulatory-text-article-3-7-2025-0415-04-pdf\/\">According to the new law<\/a>.<\/p>\n<p>In other circumstances, if an officer does not make a traffic stop, they will provide a copy of the violation to the DMV and the manufacturer within 72 hours of the incident. <\/p>\n<p>Waymo spokeswoman Julia Illina previously told The Times that the company&#8217;s vehicles are already subject to oversight by California regulators, and that the company&#8217;s autonomous driving system &#8220;is designed to respect the rules of the road.&#8221; <\/p>\n<div class=\"enhancement\" data-click=\"enhancement\" data-align-right=\"\">\n<div class=\"video-enhancement\" data-vertical=\"\" data-video-disable-history=\"\">\n<div class=\"video-enhancement-player\">    <gn-video-player class=\"gvp  block relative  aspect-(9\/16) overflow-hidden  w-full bg-cms-color-brand-background lg:z-10\" data-video-player=\"\" data-video-authors=\"Karen Garcia, Albert Brave Tiger Lee\" data-video-id=\"0000019d-e159-dce6-a7dd-f75bb3600000\" data-video-platform=\"gvp\" data-video-title=\"Waymos, robotaxis can now be ticketed by California police. For example, in the recent Santa Monica incident, the Waymo vehicle braked forcefully before impact \u2013 resulting in a &#8220;significant reduction in the speed and severity of the impact,&#8221; which the company said is &#8220;demonstrating the physical safety benefit to the Waymo driver.&#8221;<\/p>\n<h2 id=\"how-do-violations-work\" class=\"subhead\">How do violations work?<\/h2>\n<p>Starting July 1, California law enforcement agencies can issue a notice of AV noncompliance when an autonomous vehicle does not follow traffic laws. Because such vehicles operate through a mix of integrated hardware and software systems, &#8220;the manufacturer is the entity responsible for getting the behavior correct,&#8221; Groveman said.<\/p>\n<p>When a notice is submitted, he said, the DMV will review the incident, conduct any necessary investigations and determine what measures, if any, are necessary.<\/p>\n<p>&#8220;If a manufacturer is unable to correct the problem or has repeated noncompliance, the Department may take administrative action, including restricting or suspending the manufacturer&#8217;s operating permit,&#8221; Groveman said. <\/p>\n<p>The other entity that investigates autonomous vehicles and issues recalls is the National Highway Traffic Safety Administration. Waymo in particular has been the focus of several NHTSA investigations, including the recall of more than 1,200 vehicles last year due to a software flaw that led to several minor crashes.<\/p>\n<h2 id=\"other-new-regulations-for-driverless-cars\" class=\"subhead\">Other new rules for driverless cars<\/h2>\n<p>Under newly adopted state rules, autonomous vehicle manufacturers must: <\/p>\n<ul class=\"rte2-style-ul\">\n<li>Before applying to put the vehicle on the road, complete a total of 50,000 or 500,000 miles of testing, depending on the weight classification of the vehicle. Testing should include trips with a human behind the wheel for safety, as well as completely driverless trips.<\/li>\n<li>Annually update first responder interaction plans, access to manual vehicle override systems, two-way communication links with 30-second response times, and training requirements to ensure safe and timely interactions.<\/li>\n<\/ul>\n<p>Law also:<\/p>\n<ul class=\"rte2-style-ul\">\n<li>Authorize local emergency response officials to issue emergency geofencing directives directing their fleets to leave an identified area within two minutes to limit conflicts during active emergency situations;<\/li>\n<li>Establishing standards for remote operations personnel, including licensing qualifications, as well as permitting and training requirements for remote drivers and assistants;<\/li>\n<li>Modernize data reporting requirements focusing on new safety metrics including system failures, vehicle immobilization and hard-braking incidents;<\/li>\n<li>Authorize the DMV to impose targeted operating restrictions on manufacturers, including limitations on fleet size, location, speed, and weather, when necessary for public safety;<\/li>\n<li>Remove restrictions on the operation of autonomous vehicles with a gross vehicle weight rating of 10,001 pounds or more, opening the California market to autonomous vehicle freight operations \u2013 subject to applicable state and federal requirements;<\/li>\n<li>Allow autonomous transit vehicles rated up to 14,001 pounds gross vehicle weight to be operated by public entities or universities, providing a new avenue for transit service innovation.<\/li>\n<\/ul><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Driverless cars haven&#8217;t always followed the rules of the road, but unlike vehicles with humans behind the wheel, they&#8217;ve gotten away with it.
