The lawsuit alleges that Apple misled customers by promising AI features that did not ship when new devices arrived. Expect payments between $25 and $95 per eligible device.<\/p>\n<p>In a statement to CNET managing editor David Lumb, an Apple spokesperson said, &#8220;Apple has reached an agreement to resolve claims related to the availability of two additional features. We have resolved this matter to allow our users to focus on what we do best, providing the most innovative products and services.&#8221;<\/p>\n<h2>Why is Apple Intelligence being sued?<\/h2>\n<p>When Apple advertised its new iPhone 16 series of phones, it emphasized how they were optimized for AI features such as <span section=\"shortcodeLink\"><span>advanced siri<\/span><\/span>    Which can act as an intelligent agent. When the phones arrived, Apple Intelligence wasn&#8217;t ready yet; Its first features did not arrive until iOS 18.1, five weeks later.<\/p>\n<p>according to <a rel=\"noopener nofollow\" target=\"_blank\" href=\"https:\/\/www.scribd.com\/document\/1035394118\/Landsheft-v-Apple-Proposed-Settlement\" title=\"(opens in a new window)\" class=\"c-regularLink\">proposed settlement<\/a>&#8220;Apple allegedly flooded the market with misleading advertising, inducing consumers to purchase iPhones based on the promise of certain advanced Siri features.&#8221;<\/p>\n<p>Some Apple Intelligence features became available shortly after the introduction of iPhone 16 and iOS 18, including <span section=\"shortcodeLink\"><span>visual intelligence<\/span><\/span>, <span section=\"shortcodeLink\"><span>live translation<\/span><\/span>, <span section=\"shortcodeLink\"><span>writing instrument<\/span><\/span>, <span section=\"shortcodeLink\"><span>Genmoji<\/span><\/span>    And <span section=\"shortcodeLink\"><span>cleanliness<\/span><\/span>. But these were not the advanced features that Apple highlighted.<\/p>\n<h2>Who is eligible for the $250 million settlement?<\/h2>\n<p>Customers who purchased one of the following instruments between June 10, 2024, and March 29, 2025, are eligible to receive the settlement payment:<\/p>\n<ul>\n<li>iPhone 16 <\/li>\n<li>iPhone 16E <\/li>\n<li>iPhone 16 Plus <\/li>\n<li>iPhone 16 Pro <\/li>\n<li>iPhone 16 Pro Max <\/li>\n<li>iPhone 15 Pro <\/li>\n<li>iPhone 15 Pro Max<\/li>\n<\/ul>\n<p>The iPhone 15 Pro and iPhone 15 Pro Max are included because they had the processor and memory to run Apple Intelligence features.<\/p>\n<p>It is estimated that around 36 million customers are eligible for this settlement.<\/p>\n<h2>How to Claim Your Share of the Settlement<\/h2>\n<p>For now you will have to wait.<\/p>\n<p>As set out in the agreement, Apple will provide the settlement administrator with a list of eligible customers and their contact information. <\/p>\n<p>Once the data is verified, Company Verita will send emails and postal notices to direct those customers to a settlement website. That site is not built yet. The deadline to file your claim will be 90 days after your notice is received.<\/p>\n<h2>When can customers expect to receive settlement payments?<\/h2>\n<p>According to the agreement, Apple must provide information about affected customers within five days of settlement approval, scheduled for June 17, 2026.<\/p>\n<p>When the data is provided and verified, a 45-day notice period begins to notify potential consumers that they are eligible for payment.<\/p>\n<p>Actual payment of claims will occur within 60-calendar-days after final details, such as exclusions and objections, are worked out.
