“The Constitution divides power between the state and federal governments to secure the liberties of Americans,” they write in a brief filed in the Justice Department lawsuits against Georgia and Massachusetts.<\/p>\n
Trump has called on Republicans to “nationalize voting” and continues to push claims of voter fraud in the 2020 presidential election.<\/p>\n
Ginsburg and Bauer say whether the federal government can demand copies of state voter rolls is a question that is certain to be answered by the Supreme Court. But he says the Justice Department’s lawsuits against 29 states and the District of Columbia are creating confusion during the midterm election year.<\/p>\n
“While this case may ultimately be resolved, the immediate impact is significant,” Bauer said. “That’s why it’s really important to put those views, which we hope will ultimately prevail, in the courts as forcefully as possible.”<\/p>\n
Many other notable names in election law have joined Ginsburg and Bauer in their effort. Former Biden campaign lawyer and White House counsel Dana Remus is participating as board members, along with former Obama Solicitor General Donald Verrilli and Biden-Harris lawyer John Deveney. Prominent Republican litigator Michael Carvin and former George W. Bush administration official Daniel Troy will serve on a senior advisory group.<\/p>\n
