The United States Supreme Court has cleared the way for the Justice Department to move forward with its dismissal of a criminal case against President Donald Trump’s key aide Steve Bannon, who was convicted after refusing to testify or provide documents to Congress despite being issued a subpoena.<\/p>\n
The department’s request to drop Bannon’s case was one of several actions that have benefited the Republican president’s allies and supporters since Trump returned to office last year.<\/p>\n
Bannon serves a four-month prison sentence after pleading guilty in 2022 to two counts of contempt of Congress for refusing to provide documents or testify to the House committee investigating the attack on the U.S. Capitol by Trump supporters on January 6, 2021.<\/p>\n
Trump’s Justice Department urged the Supreme Court to dismiss the lower court’s decision, telling the justices in court papers that it has determined that dismissing Bannon’s case “is in the interests of justice.” The department had already filed a motion to dismiss the case at the trial court level.<\/p>\n
Bannon’s lawyer, Ivan Corcoran, welcomed the Supreme Court’s action on Monday.<\/p>\n
“It’s been five years of battle after battle, but today the Supreme Court vacated an unjust conviction, and in doing so validated a fundamental rule \u2013 like oil and water, politics and prosecution do not mix,” Corcoran said.<\/p>\n
Dismissal would remove Bannon’s conviction from the record, but it would have little practical effect because he has already served his sentence.<\/p>\n

Bannon, 72, served as a key adviser to Trump’s 2016 presidential campaign and his chief White House strategist during Trump’s first term in 2017, but they had a falling out that was later resolved.<\/p>\n
Bannon was released from prison a week before Trump’s victory over Democrat Kamala Harris in the 2024 US presidential election.<\/p>\n
Bannon presented himself as a political prisoner and told reporters upon his release, “I am not broken yet. I have been empowered during the four months I spent in Danbury federal prison.”<\/p>\n

A firebrand, Bannon helped articulate the “America First” right-wing populism and strident opposition to immigration that has helped define Trump’s presidency.<\/p>\n
Bannon has played a significant role in right-wing media, promoting right-wing issues and candidates in the US and abroad.<\/p>\n
Bannon’s lawyers made various legal arguments to oppose the subpoena, including issues related to executive privilege, a legal doctrine that allows the President to keep certain communications private, and the authority of a congressional committee to issue a subpoena.<\/p>\n
