After years of legal wrangling, the $2.67 billion Blue Cross Blue Shield (BCBS) antitrust settlement has finally moved into its payment phase by May 2026.
The settlement stems from a decade-long class-action lawsuit alleging that BCBS engaged in anti-competitive practices by limiting its access to the health insurance market.
In this legal battle, BCBS was also accused of carving out geographic areas to avoid competing with each other, leading to a reduction in choices for consumers as well as increased health care costs.
Blue Cross Blue Shield has denied the allegations but has agreed to settle the lawsuit.

While the key figure is $2.67 billion, the actual amount distributed to claimants is less after legal and administrative expenses.
Gross Settlement Fund: $2.67 billion
Net Settlement Fund: About $1.9 billion after deducting about $700 million in attorney fees and costs.
The estimated average payment is approximately $300-$333 per valid claim, but this figure can vary depending on individual premium history, such as how long you were enrolled in BCBS coverage, the amount of premium you paid, the type of insurance coverage, and the total number of claims approved.
Talking about total claims, approximately 60 lakh valid claims were submitted.
Eligibility to claim payment
The following criteria must be met to claim payment. The deadline to file claims was November 5, 2021. If you miss the deadline, you are ineligible for this payment.
Must be covered by the BCBS plan during the following windows:
- Individuals and fully insured groups: February 7, 2008 – October 16, 2020
- Self-Funded Accounts: September 1, 2015 – October 16, 2020
When and how to receive payment
The payment process officially started in early May 2026. Payments are being issued according to the method chosen by claimants, including direct deposit, physical checks and electronic transfers.
A historic antitrust battle has come to an end as Blue Cross Blue Shield begins issuing settlement checks. For the 6 million people and businesses who filed claims years ago, this month marks the long-awaited arrival of their payments.
