    (Qualified News) – The 8th U.S. Circuit Court of Appeals ruled Monday that Iowa can enforce its law banning LGBT-related instruction in classrooms and limiting sexually explicit material in school libraries, marking a significant legal victory for parental rights and local control of education.

    The three-judge panel overturned a lower court ruling that had halted enforcement of the law, which Kim Reynolds signed into law, in 2023. The purpose of the law is to ensure that students from kindergarten to high school receive age-appropriate instruction and are not exposed to explicit or controversial material without parental awareness.

    The decision addressed two separate legal challenges – one brought by major publishing companies including Penguin Random House, HarperCollins Publishers and Macmillan Publishing Group, and the other filed by education advocacy groups.

    In its decision, the Court relied heavily on the precedent established by Hazelwood School District v. Kuhlmeier, which established that schools have a right over school-sponsored speech involving legitimate educational concerns. The panel concluded that school libraries, being curated by authorities, fall into this category – giving schools the right to regulate the materials available.

    The court also rejected arguments that the law’s restrictions on classroom discussion were unconstitutionally vague. The judges found that a person of “common intelligence” could reasonably understand the law, and determined that the lower court had overstepped in preventing its enforcement.

    Iowa Attorney General Brenna Byrd praised the decision and called it a big step forward for families. He stressed that parents should be assured that their children are not being exposed to inappropriate or ideologically motivated material in public schools.

    Opponents, including the ACLU of Iowa, criticized the decision, warning that it could be used to limit free expression and discriminate against certain viewpoints. Senior lawyer Thomas Storey argued that the law is overly broad and harmful to students.

    The cases will now return to lower courts for further proceedings, but the appellate ruling allows Iowa to enforce the law in the meantime – setting off a continuing national debate over education, parental rights and the role of public schools in shaping cultural values.
