The decision in a civil suit was the first time a judge had considered XAI’s responsibility for creating tools that could be used to create sexually explicit images, amid a flood of complaints and investigations into Grok in the US, Europe, Asia and Australia.
Grok was launched by Musk in 2023 and distributed through his social media platform X, which is now part of his rocket and space exploration company SpaceX.
Offlimits, a Dutch center that monitors online violence, took legal action in collaboration with the non-profit Victim Support Fund over the Grok feature, which asked users to create hyper-realistic deepfake montages of naked women and children using real photographs.
At this month’s hearing, xAI’s lawyers had argued that it was impossible to guarantee that abuse could be prevented on its platform, and that the company should not be punished for the actions of malicious users.
He said the company had taken measures in January to prevent Grok from editing images of real people in revealing clothing, including restricting its image creation features to paid customers.
The judge has decided that Offlimits has shown that there is reasonable doubt over the effectiveness of the measures taken to date, the court website said. “For example, Offlimits managed to capture a video of a naked man using Grok shortly before the hearing,” it says.
Robert Hoving, director of OffLimits, said that “the burden is on the company” to ensure that its devices are not used to create and distribute non-consensual sexual images, including those of children.
Earlier on Thursday, the European Parliament approved a ban on artificial intelligence systems generating erotic deepfakes, following a global outcry over non-consensual grok-produced nude pictures.
